WA! GACHI TERMS OF USE

Article 1 (Scope of Application)

1 Wa! GACHI Terms of Use (hereinafter referred to as the "Terms") GACHI" (hereinafter referred to as the "Site"), you agree to be bound by the terms and conditions of the "Wa! Article 2 (Price)

1 The prices of our products listed on this website ("Website Prices") are the prices at which we sell our products on the Website.

2 Website prices are prices including tax for our products. There is no delivery charge, but customers are responsible for Internet connection fees and other telecommunication line communication costs for accessing the website, as well as fees and other costs such as settlement charges, as stipulated in the contract with the operator with whom the customer has a contract.

3 The Company reserves the right to change its website prices without notice.

Article 3 (Orders)

1 You shall order our products through the Site.

Article 4 (Method of Payment, Sales Contract)

5. The purchase contract between a customer and the Company through credit card payment shall become effective upon confirmation of the purchase order as set forth in the preceding paragraph.

However, if an order placed through this site fails to reach our company due to a malfunction of the communication environment, etc., the sales contract for the ordered products will not be concluded. In such a case, the Company shall not be liable for any loss or damage incurred by the customer.

Please note that when your purchase is confirmed, we will send an e-mail to you confirming that your order is complete.

6 If we are unable to obtain approval from the credit card company for a credit card transaction, we may cancel your purchase application for any reason. In such cases, the Company shall not be liable in any way.

7 If you use installment or revolving payments by credit card, a separate fee will be charged as specified by the credit card company. Terms and conditions, such as number of payments, vary from credit card company to credit card company. Please contact your credit card company for details.

8 Please be advised that we may call you to confirm your order.

9 Even after the conclusion of a purchase contract, if the customer's payment method is found to be inadequate, illegal, etc., we may terminate the contract at our discretion without incurring any liability.

Article 5 (Delivery, transfer of ownership)

1 After a sales contract is concluded between the Company and the customer, the Company will produce the ordered products and deliver them to the delivery address specified by the customer (hereinafter referred to as the "Delivery Address"). 4 Ownership of the Ordered Products shall transfer from the Company to the customer at the time the Ordered Products reach the delivery address.

Article 6 (Returns, Exchanges, and Contract Cancellation)

1 The customer may return or exchange ordered products or cancel the contract only in the case of non-conformity to the contract as stipulated in the following article, or in the case of reasons for cancellation as stipulated in Article 541 and Article 542 of the Civil Code. Other than that, we do not accept any cancellations, returns, or exchanges for the customer's own convenience.

2. When returning or exchanging an Ordered Product in accordance with the preceding paragraph, please return the Ordered Product and any accessories that were included with the Ordered Product at the time of delivery, using the original packing box in which the Ordered Product was delivered. Even if the customer's personal belongings are mixed in the packing box, the Company will not return the items to the customer.

Article 7 (Nonconformity to Contract)

1. If the ordered product does not conform to the terms of the contract, you must notify us within five (5) days from the day following the day the ordered product arrives at the delivery address (or within the warranty period if another warranty period is indicated for the ordered product), by using the "Contact Us" form on the Site ( Please notify us by using the "Contact Us " form on the Site (https://wa-gachi.myshopify.com/pages/contact) or by any other method.

2. Upon receipt of a notice as described in the preceding paragraph, we will confirm the details of the nonconformity with respect to the ordered products. Please be advised that we may call you to confirm the details.

3 After the customer completes the delivery procedures for the Ordered Products to be returned or exchanged to the Company, please contact the Company with the name of the delivery company and the package invoice number (slip number). After receiving such notification from the customer, we will return the ordered merchandise to the Company and confirm that there is a non-conformity with the contract, and then we will refund or cancel the claim by wire transfer to the account designated by the customer. It will take a certain number of days for the refund or cancellation to be processed. Please note that we do not accept any reduction of the price.

4 The customer shall be responsible for the shipping costs of the ordered products and the amount equivalent to consumption tax on such shipping costs for returned products.

Article 8 (Handling of Personal Information)

We manage the personal information of subscribers in our possession in accordance with the personal information protection policy set forth by us.

Article 9 (Disclaimer)

1. In the event that the Company is liable for damages to you due to its failure to fulfill its obligations under these Terms and Conditions, the amount of compensation shall be limited to the amount equivalent to the price paid by you for the Product(s) directly causing the damages.

2 In no event shall we be liable for damages arising from reasons not attributable to us, damages arising from special circumstances with or without our foreknowledge, or lost profits.

3 The provisions of the preceding two paragraphs shall not apply if any damage suffered by the customer as a result of the Company's failure to perform its obligations under these Terms and Conditions is caused by the Company's willful misconduct or gross negligence.

Article 10 (Restrictions)

1 Although the ownership of the ordered product belongs to the customer upon purchase, the wooden form of our product is a copyrighted work and the copyright belongs to our company even after purchase. There is no problem about installing them at home for ornamental purposes, but please use them within the scope permitted by the Copyright Law and other laws and regulations.

2 Our products are sold as ornamental crafts of wooden forms of Japanese confectionery, and are not sold for the processing of food products such as Japanese confectionery. Customers shall not use or transfer the ordered products for processing food products. Due to safety and food sanitation regulations, we shall not be liable for any damage to yourself or a third party caused by the use or transfer of the ordered products for the processing of food products such as Japanese confectionery.

Article 11 (Exclusion of Antisocial Forces, etc.)

1. The Customer shall ensure that it does not and will not fall under any of the following (hereinafter referred to as "Anti-Social Forces, etc."), and that it does not and will not have any relationship with Anti-Social Forces, etc.
(i) Persons who are "organized crime groups," "members of organized crime groups," "quasi-constituents of organized crime groups," "companies affiliated with organized crime groups," "general assemblymen," etc., "social movement, etc.," "special-intelligence violent groups," or other similar groups as described in the National Police Agency's "Outline of Organized Crime Countermeasures.
(ii) Persons who have close personal, financial, or economic relationships with persons described in the preceding items, including providing funds or favors or using them for the purpose of making illicit gains. (iii) Persons who have a close personal, financial, or economic relationship with those listed in the preceding item, such as by providing funds or favors or using them for illicit gain.

2. The Customer shall ensure that it will not, by itself or through the use of a third party, engage in any of the following acts
(1) Use of fraudulent, violent or threatening language
(2) Illegal acts or unreasonable demands
(3) Interference with business
(4) Defamation of honor or credit
(5) Acts similar to each of the preceding items

3 If you breach any of the preceding paragraphs, Fuji Xerox may immediately terminate the purchase agreement based on these Terms and Conditions without any notice to you, without incurring any obligation to compensate you for damages.

Article 12 (Temporary Suspension of this Service)

1 In order to keep the Service in good working condition, SOFTBANK TELECOM may temporarily suspend provision of all or part of the Service for maintenance and inspection.

2 In the case of the preceding paragraph, SOFTBANK TELECOM will notify the subscriber in advance of the temporary suspension of the provision of the Service and the period of such suspension. However, this shall not apply in cases of emergency.

3. MTI shall not be liable for any damages incurred by the subscriber as a result of the temporary suspension of the Service pursuant to this Article.

Article 13 (Prohibition of Transfer)

You may not transfer your rights and obligations under these Terms and Conditions and the sales contract concluded with the Company to any third party.

Article 14 (Notification)

Notices from the Company to the Subscriber shall be addressed to the e-mail address or other contact address that the Subscriber has provided to the Company at the time of application for the Service Agreement, and shall be deemed to have arrived at the time when the notice should normally have arrived.

Article 15 (Governing Law)

These Terms and Conditions shall be construed in accordance with the laws of Japan.

Article 16 (Court of Jurisdiction)

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, and any dispute between you and the Company with respect to these Terms and Conditions shall be submitted to the Chiba District Court or the Chiba Summary Court as the court of first instance.

Supplementary Provision: These Terms and Conditions shall apply from July 11, 2024.
